Terms & Conditions

Please note that this Terms and Conditions is split into two sections: General and Weddings. The General Terms and Conditions apply on top of the Wedding Terms and Conditions for Wedding Packages.

General Terms and Conditions

Red Disc Media and the Client acknowledge that the following Terms and Conditions are to be incorporated into any Agreements between both parties. The only way to change the agreement is to have Red Disc Media agree to the alteration in writing.

Booking and Retainer

For a booking or service with Red Disc Media, a non-refundable retainer of up to 50% is required to confirm and hold any booking or service, which also serves as a cancellation fee.

Cancellation

If the Client wishes to cancel their booking for any reason (including COVID-19 restrictions), the Client forfeits their retainer as a cancellation fee. The fee may be credited towards a future booking as long as the re-scheduled booking is organised and confirmed with Red Disc Media at least 72 hours before the original booking.

Delivery

The final products will be delivered via an online link where the Client can download the full resolution media to their own devices. This link will expire after 30 days, but the Client can contact Red Disc Media to retrieve a new link if required.

Additional Charges

If on the day of filming, the Client wishes for Red Disc Media to film any additional video outside the scope initially agreed to in the quote, then additional charges may be applied. Red Disc Media reserves the right to refuse the filming of any additional content.

Attendance and Refunds

In the event that Red Disc Media is unable to attend due to serious illness, fire or casualty, a full refund including the retainer will be issued.

Invoices and Late Payments

Red Disc Media will issue an invoice after the proof photos and/or videos have been returned to the client. A watermark may be applied to the products and only removed once the full payment has been made. The client shall pay Red Disc Media within 30 days of the invoice being sent. Late payments will be subject to 1.5% monthly interest and $20.00/month handling fee.

Venue Location Fees & Permissions

The Client must gain necessary permission or pay the fees which may apply for Red Disc Media to film at a particular location, venue or event.

Equipment Failure

In the case of catastrophic equipment failure or file loss, Red Disc Media will issue a full or partial refund to the Client. The liability of Red Disc Media, in this case, will be limited to the refund issued.

Limitations from venues

In some cases, Red Disc Media may be restricted by the venue. Some venues may restrict the movement of photographers/videographers, have limited light, or prohibit the use of flash. It is the responsibility of the Client to check these restrictions and in turn, inform Red Disc Media prior to the booked date. Red Disc Media will not be held responsible for the lack of photographs/footage delivered due to these restrictions.

Revisions and Editing Process

Red Disc Media will offer the client one round of minor editing revisions, as determined by them. Any revisions after this may be offered as an additional extra. A quote for the re-editing will be provided on request.

Red Disc Media's editing includes colour grading of select images and video. However, this does not include digital manipulation techniques such as the removal of pimples, scars, double chins etc. This may be offered as an additional extra to the original quote and will be quoted upon request by the Client. Red Disc Media reserves the right to deny or accept any of these requests.

Artistic Licence

Red Disc Media reserves the right to use 'Artistic License' in the editing and filming of client projects as they see fit. The Client acknowledges that they are familiar and happy with the style of the content produced by Red Disc Media. Moreover, the Client acknowledges that the style of Red Disc Media is constantly evolving and changing and may differ from previous pieces of work.

Image/Footage Use

Red Disc Media may use any of the images or videos captured, for promotion on social media, their website and any other form of advertising. The Client must inform Red Disc Media if they do not wish for images or footage captured during the project/booking to be used for this purpose.

Rights to the Media Produced

Red Disc Media retains the rights to all the videos or photos produced during a shoot. The client will receive a full resolution copy of the final video, but the rights to the videos or photos remain with Red Disc Media. The client may distribute the video within what was initially agreed upon without permission, however, permission must be sought for deviations from this. The Client can not claim that they filmed or produced the media nor use sections of it as part of another production without written permission from Red Disc Media.

Personal Accident

Any directions issued by Red Disc Media to Clients, their guests or employees during a photo/video shoot are taken at the person's own risk. The photographer/videographer will not be held responsible for any personal accidents during a photo/video shoot.

Talent Performance

Before presenting to the camera, it is recommended that the talent rehearses their acts. Red Disc Media will not be held accountable for a talent's performance and may charge extra for additional filming if required.

Wedding Specific Terms and Conditions

The following terms and conditions apply only to weddings. The above general terms and conditions also apply.

Booking and Payment for Weddings

For all wedding packages and dates, a 30% non-refundable retainer is required to confirm and hold any booking and also serves as a cancellation fee.

Cancellation for Weddings

Breaks and Meals at Weddings

During weddings, Red Disc Media's photographers/videographers will be allowed to take bathroom breaks when necessary. They will also have a guest or service meal provided if they are attending packages that cover a wedding reception. If no meal is provided, they will be allowed to leave for an off-site meal for up to 45 minutes. Red Disc Media photographer/videographers may take one break of 20 minutes at a time of their own judgement.

Coverage of Weddings

Given the diverse and unpredictable nature of weddings, not everything can be covered. If the Client wants to ensure something specific is covered they must contact Red Disc Media about it prior to their wedding day. While every effort will be made, complete coverage cannot be guaranteed.
